Oh, the infamous subpoena — the legal version of a surprise visit from your mother-in-law. Subpoena Response Deadline

Let's get real here, folks. Responding to subpoenas isn't just about handing over the goods—there are rules to follow, or else you'll be in hot water faster than you can say "objection overruled!" State and federal regulations are like the referees of the legal world, making sure everyone plays by the rules. And if you break those rules, well, let's just say it won't be pretty.

Federal Rule of Civil Procedure 45, along with related case law, provides the framework for third-party subpoena response in federal civil litigation.

The first three subsections of FRCP 45 establish the general requirements for issuing a subpoena, including its form and contents (subsection a), service (subsection b), and place of compliance (subsection c).

But don't worry, you don't have to be a legal eagle to understand these regulations. Just think of it like following the instructions on a cake mix box—it might seem like a hassle, but it's necessary to avoid a disaster. So, pay attention to issues like confidentiality, proper service, and allowable objections. You don't want to accidentally spill the beans on sensitive information, serve the wrong person, or object to something that's totally allowed.

Sanctions for undue burden and expense are governed by FRCP 45(d)(1).

Objections to third-party subpoenas are governed by FRCP 45(d)(2)(B), which specifies that such objections must be made within 14 days after the subpoena is serviced.

For a motion to quash or modify a subpoena, FRCP 45(d)(3) establishes two burden-shifting tests, one for objections based on undue burden and one for those based on the disclosure of trade secrets.
