CCPA Privacy Policy

This privacy notice for California Residents supplements and is in addition to the information contained in Logik Systems, Inc.’s (collectively, "Logikcull", "we", "us", or "our") Privacy Policy located at https://www.logikcull.com/privacy-policy (“Logikcull Privacy Policy”) and applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you") who access the logikcull.com web site or the Logikcull service application ("Services") available at app.logikcull.com/login (collectively, "Sites"). We adopt this privacy notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this notice.

This privacy notice does not apply to any third party applications or software that integrate with the Services through the Logikcull platform ("Third Party Services"), or any other third party products, services or businesses. In addition, a separate agreement governs delivery, access and use of the Services and Sites ("Terms of Service"), including the processing of any Hosted Data (as defined in the Logikcull Privacy Policy). Each customer entering into the Terms of Service controls their instance of the Services and any associated Hosted Data. COLLECTION OF INFORMATION

Logikcull may collect and receive Hosted Data and Service Data (as each is defined in the Logikcull Privacy Policy) in a variety of ways. Customers and Customer's users routinely upload Hosted Data to Logikcull when using the Services. Customers and Customer's users control what Hosted Data is submitted to the Services, and may choose not to submit Hosted Data.

Service Data may include information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("Personal Information"). Logikcull’s Sites may have collected the following categories of Personal Information from its Customers and its Customer’s users within the last twelve (12) months: [U2]

  • Various identifiers, including, name, address, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), including, telephone number, bank account number, credit card number, debit card number, or any other financial information (to the extent Customer purchases a paid version of the Services provided by Logikcull).
  • Commercial information, including, records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Biometric information, including, behavioral characteristics, or activity patterns used to extract a template or other identifier or identifying information.
  • Internet or other similar network activity, including browsing history, search history, information on a consumer's interaction with a website, application, or advertisement, including protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, the files viewed on Logikcull's sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data in order to analyze trends in the aggregate and administer the Sites.
  • Geolocation data, including, physical location or movements.
  • Sensory data, including, audio, electronic, visual, or similar information.
  • Professional or employment-related information, including, current or past job history.
  • Inferences drawn from other personal information, including, profile reflecting a person's preferences, characteristics, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Directly from you as a user of the Sites and Services.
  • Indirectly from you when you interact with the Services and Sites, including when metadata is generated and gathered automatically that provides additional context about the way you work. Logikcull also collects information about devices accessing the Services and Sites, including type of device, what operating system is used, devise settings, application IDs, unique device identifiers and crash data.
  • We may receive information about you from other sources, such as third parties (lead generation sources) from whom we obtain data, and combine this data with information we already have about you.
  • For completion and support of the activity for which the information was provided, such as allowing access to or delivery of Logikcull's products or Services or responding to your requests or inquiries, or as otherwise required by applicable law.
  • In furtherance of Logikcull's legitimate interests in operating Logikcull's Sites, Services and business.
  • For site and system administration such as for the technical support of the Sites and its computer systems, including processing computer account information, information used in the course of securing and maintaining the Sites, and verification of activity on the Sites by Logikcull or its agents.
  • To conduct research and development to enhance, evaluate, and improve the Sites and Services.
  • As required by applicable law, legal process or regulation.
  • To develop and provide additional tools and features for the Sites and Services.
  • To send emails and other communications.
  • For billing, account management and other administrative matters.
  • To investigate and help prevent security issues and abuse.
  • As described to you when collecting your Personal Information or as otherwise set forth in the CCPA.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Logikcull's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Logikcull about our Site users is among the assets transferred.
  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose for collecting or selling that Personal Information.
  • The categories of third parties with whom we share that Personal Information.
  • The specific pieces of Personal Information we collected about you.
  • If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing: sales, identifying the Personal Information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Personal Information does not include information that is publicly available or information that is deidentified or aggregated.

Certain information may be excluded from the CCPA's scope because it is subject to protection under federal law.

Whether Logikcull collects some or all of this Service Data often depends on the type of device used and your settings.

In the preceding twelve (12) months, Logikcull may have disclosed all of the above categories of Personal Information for a business purpose to a third party service provider in connection with providing the Sites and Services.

HOW PERSONAL DATA IS USED

Logikcull may use, sell, or disclose the Personal Information we collect for one or more of the following purposes:

Logikcull will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Third Parties:

Logikcull may disclose your Personal Information to a third party for a business purpose or sell your Personal Information, subject to your right to opt-out of those sales below. The CCPA prohibits third parties who purchase the Personal Information we hold from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales.

We share your personal information with service providers, including software service providers and individuals who perform functions on our behalf.

In the preceding twelve (12) months, Logikcull may have sold all of the categories of Personal Information set forth above to third parties, including data aggregators.

California Resident Rights:

The CCPA provides California residents with specific rights regarding their Personal Information.

ACCESS AND DATA PORTABILITY

You have the right to request that Logikcull disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm a verifiable request from you, we will disclose to you:

DATA DELETION

You have the right to request that Logikcull delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm a verifiable request from you, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

EXERCISING YOUR CALIFORNIA RESIDENT RIGHTS:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

Any verifiable request must include sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information (or an authorized representative) and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.

SALE OF PERSONAL INFORMATION:

We do not sell your Personal Information.

Non-Discrimination:

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services or charge you different prices for exercising your rights.

OTHER CALIFORNIA RESIDENT RIGHTS:

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Sites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@logikcull.com.

Do-Not-Track signals are certain consumer browser settings that request that a web application disable its tracking of an individual user. While our Sites do not currently recognize Do-Not-Track signals, we do not track activities that occur on websites other than our own and declining to accept cookies will ensure that online activities on our websites are not tracked.
