This privacy policy applies to the logikcull.com web site and the Logikcull service application ("Services") available at app.logikcull.com/login (collectively, "Sites"), owned and operated by Logik Systems, Inc. (collectively, "Logikcull", "we", "us", or "our"). Logikcull is committed to maintaining your confidence and trust with respect to the information Logikcull collects from you. This Privacy Policy explains when and how Logikcull collects personal data, sets forth the information Logikcull collects about you, how Logikcull uses this information, and the choices you have about how Logikcull uses such information. Except as otherwise expressly set forth herein, the use of information collected through Logikcull's Services shall be limited to the purpose of providing the Services for which the customer has engaged Logikcull. If you do not agree with the terms, do not access or use the Services, Sites or any other aspect of Logikcull's business.

This Privacy Policy does not apply to any third party applications or software that integrate with the Services through the Logikcull platform ("Third Party Services"), or any other third party products, services or businesses. In addition, a separate agreement governs delivery, access and use of the Services and Sites ("Terms of Service"), including the processing of any data, files or other content submitted through customer's or its user's use of the Service accounts (collectively, "Hosted Data"). Each customer entering into the Terms of Service controls their instance of the Services and any associated Hosted Data. COLLECTION OF INFORMATION

Logikcull may collect and receive Hosted Data and Service Data ("Service Data", Hosted Data and Service Data, collectively referred to as "Information") in a variety of ways:

Hosted Data : Customers and Customer's users routinely upload Hosted Data to Logikcull when using the Services. Customers and Customer's users control what Hosted Data is submitted to the Services, and may choose not to submit Hosted Data.

Service Data:

Logikcull also collects, generates and/or receives Service

Data:

Logikcull may request users of the Sites and Services to provide personal data such as name, email address; and business information such as company name and address (other than Hosted Data).
Customers that purchase a paid version of the Services provide Logikcull (or its payment processors) with billing details such as credit card information, banking information and/or a billing address.
The Sites and Services may provide you with messaging capabilities for your use. In the event you voluntarily disclose sensitive or personal data using such services, that information, along with any substantive information disclosed in your communication or post, can be collected, correlated and used by specific third parties. Any use of such Information shall be for the limited and legitimate purposes for which Logikcull is using such third party's product or service to provide the Service or Site to you.
When you interact with the Services and Sites, metadata is generated and gathered automatically that provides additional context about the way you work. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, the files viewed on Logikcull's sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data in order to analyze trends in the aggregate and administer the Sites. Logikcull also collects information about devices accessing the Services and Sites, including type of device, what operating system is used, devise settings, application IDs, unique device identifiers and crash data.
Whether Logikcull collects some or all of this Service Data often depends on the type of device used and your settings.
We may receive information about you from other sources, such as third parties (lead generation sources) from whom we obtain data, and combine this data with information we already have about you. This helps us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you. If you provide us personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us. Examples of the types of personal information that may be obtained from third parties and combined with information we already have about you, may include contact information such as name, email business address, and phone number.

Cookies/Tracking Technologies/Passive Collection:

Logikcull and its partners use cookies or similar technologies in the Services and Sites to analyze trends, administer the Sites, track users' movements within the Sites, and to gather demographic Logikcull collects information automatically regarding your use of the Sites through the use of cookies. Cookies are unique alphanumeric identifiers sent to your browser from a website's computers and stored on your computer. The type of information Logikcull collects as a result of a cookie being stored on your computer includes the Internet protocol (IP) address used to connect your computer to the Internet; computer and connection information such as browser type and version, operating system, and platform; and click stream data, including date and time, cookie Logikcull collects and uses, and may from time to time supply third parties with, pseudonymized, aggregated user data for the purposes of site usage analysis, quality control and improving the Sites. Logikcull uses temporary "session" cookies to maintain information Logikcull needs to have in order for you to view content and browse from page to page. Logikcull uses "persistent" cookies to give you a more personalized browsing experience and to help you navigate. The cookie will not collect personal data that is subject to the protections under the General Data Protection Regulation ("GDPR") when dealing with personal data from the European Union, the European Economic Area and their member states, Switzerland. You can prevent your browser from accepting new cookies, have the browser notify you when you receive a new cookie, or disable the cookies through your browser settings. With respect to the Site, certain cookies are necessary for Logikcull to operate and disabling any such cookies may result in the inability to use or access the Site or Services. If cookies are disabled you may not be able to take advantage of some of the site features.

Third Parties:

Logikcull may share Service Data with its corporate affiliates, parents and/or subsidiaries (if any).
Logikcull employs other companies, software services and individuals to perform functions on its behalf. Examples include storing and processing data, providing marketing assistance, email and chat services and contract management. Such third parties have access to personal data as needed to perform their functions, but may not use it for other purposes.
The Sites may contain links to other websites that are beyond Logikcull's control. You should check the privacy settings and notices in these third party services to understand what data may be collected and disclosed by these third party services. In the event you choose to access such websites, Logikcull is not responsible for any actions or policies of such third parties. This includes getting rick-rolled (up, up, down, down, left, right, left, right, b, a). Logikcull recommends that you check the applicable privacy policy, including, with respect to cookies, of such party before submitting any information to them.
Logikcull will release account and other personal data when Logikcull believes release is appropriate to comply with applicable laws; enforce or apply Logikcull's Terms of Service; or protect the rights, property or safety of Logikcull's customers or others.
Other than as set out above, Logikcull will provide you notice when your Information may be shared with a third party, and you will have an opportunity to choose not to share such Information.

Generally, no one is under a statutory or contractual obligation to provide any Information. However, certain Information is collected automatically. Additionally, if certain Information is not provided by you, such as setup details or billing information, Logikcull may be unable to provide the Services and/or Sites.

HOW PERSONAL DATA IS USED

Logikcull uses the Information that you provide for completion and support of the activity for which the information was provided, such as allowing access to or delivery of Logikcull's products or Services or responding to your requests or inquiries, or as otherwise required by applicable law.

Logikcull also may use the Information in furtherance of Logikcull's legitimate interests in operating Logikcull's Sites, Services and business. More specifically, Logikcull uses Information:

For site and system administration such as for the technical support of the Sites and its computer systems, including processing computer account information, information used in the course of securing and maintaining the Sites, and verification of activity on the Sites by Logikcull or its agents.
To conduct research and development to enhance, evaluate, and improve the Sites and Services.
As required by applicable law, legal process or regulation.
To develop and provide additional tools and features for the Sites and Services.
To send emails and other communications. Logikcull may send you service, technical and other administrative emails, messages and other types of communications. Logikcull may also contact you to inform you about changes in the Sites, Services and important related notices, such as security and fraud notices. In addition, Logikcull may sometimes communicate with you about special offers or promotions, new product features or other news about Logikcull and its Services. These are marketing messages so you can control whether you receive them.
For billing, account management and other administrative matters. Logikcull may need to contact you for invoicing, account management and similar reasons and Logikcull uses account data to administer accounts and keep track of billing and payments.
To investigate and help prevent security issues and abuse.

LOGIKCULL'S COMMITMENT TO DATA SECURITY

The security and confidentiality of your Information is important to Logikcull. Logikcull works hard to protect Information you provide from loss, misuse or unauthorized access or disclosure, and follows generally accepted industry standards to protect the personal data submitted to Logikcull, both during transmission and once it is received. Logikcull has implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk. The Information about each user is stored on servers that are behind a firewall and physically housed within secure data centers. Furthermore, Logikcull's internal practices help protect your privacy by limiting employee access to and use of Information on a permissions-based and role-specific basis. Given the nature of communications and information processing technology, Logikcull cannot guarantee that Information, during transmission or while stored on Logikcull's systems or otherwise in its care, will be absolutely safe from intrusion by others. It is important that you protect against unauthorized access to your account information and to your computer. Logikcull is committed to participate in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Logikcull is potentially liable and is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact our U.S.-based third party dispute resolution provider (free of charge) at https://feedback-form.truste.com/watchdog/request. Under certain conditions, more fully described on the Privacy Shield website [https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint], you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

ACCESS

Customers of Logikcull: In the event you are a Logikcull customer, upon request, Logikcull will provide you with information regarding whether Logikcull holds any of your personal data. You may access, correct, or request deletion of your personal data by contacting Logikcull at privacy@logikcull.com. Logikcull will respond to your request within a reasonable timeframe.
Non-Customers of Logikcull: Logikcull acknowledges that you have the right to access your portable personal data. Logikcull has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to the Logikcull customer within whose account your data exists (the data controller). If requested to remove data Logikcull will respond within a reasonable timeframe.

DATA RETENTION

Logikcull retains Hosted Data in accordance with your instructions as defined in applicable terms in the Terms of Service or, where applicable, other services agreements, or as otherwise required by applicable law.

Logikcull may retain your Service Data for as long as your account is active or as needed to provide you Services, comply with Logikcull's legal obligations, resolve disputes, and enforce agreements, and thereafter, Logikcull shall destroy or delete such Service Data within 18 months, unless otherwise required for business purposes. Notwithstanding the foregoing, Logikcull may keep any data after the periods set forth in this section to the extent such data is anonymized or as necessary for business purposes. INTERNATIONAL DATA TRANSFERS

Data protection law in certain jurisdictions differentiates between the "controller" and "processor" of information. In general, you are the controller of Hosted Data and Logikcull is the processor of Hosted Data and controller of Service Data.

Logikcull uses several safeguards if Logikcull transfers Information originating from the European Union, the European Economic Area and their member states, Switzerland and the United Kingdom to other countries not deemed adequate under applicable data protection law:

Logikcull has adopted acceptable data transfer mechanisms pursuant to the requirements of applicable international law, including the GDPR, to ensure that any handled Information originating from the foregoing states will be protected with technical and organizational security measures sufficient to meet the legal standards of the European Union, such as the EU standard contractual clauses for data transfers (see here).

GDPR: Logikcull is also committed to complying with the General Data Protection Regulation when dealing with personal data from the European Union, the European Economic Area and their member states, Switzerland and the United Kingdom. Effective May 25, 2018, you may have certain statutory rights in relation to your personal data. Subject to any exemptions provided by law, you may have the right to request access to Information, as well as to seek to update, delete or correct this Information. You can usually do this using the settings and tools provided in your Services, on the Site, or as outlined in this Privacy Policy. To the extent that Logikcull's processing of your Hosted Data is subject to the GDPR, Logikcull relies on its legitimate interests, described above, to process your data. Logikcull may also process Service Data that constitutes your personal data for direct marketing purposes and you have a right to object to Logikcull's use of your personal data for this purpose at any time.

CHOICE

Logikcull partners with a third party to manage Logikcull's advertising on other sites. Logikcull's third party partner may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests. You have a choice about whether or not you wish to receive certain information from Logikcull. You may choose to receive email-based and in-application messages from Logikcull related to things such as the completion of a processing job, project creations or deletions, collaborative communications from a user within your account, or product updates. If you would like to discontinue receiving this information, you may update your email preferences by using the "Unsubscribe" link found in the emails Logikcull sends to you or by changing your notification preferences by clicking the "My Settings" link from within the application. If needed you can contact Logikcull's Success team for help with these adjustments at success@logikcull.com. You may also opt out of marketing-related email communications by using the "Unsubscribe" link found in the emails Logikcull sends to you or by contacting Logikcull at privacy@logikcull.com. You may not be able to opt-out of certain notifications to the extent necessary to comply with applicable law or legal process and to prevent fraud or security issues.

If you are a client of one of Logikcull's customers and would no longer like to be contacted by one of Logikcull's customers that uses Logikcull's Service or if you wish to request the removal of personal data under their control, please contact the customer who you interact with directly.

ABOUT THIS PRIVACY POLICY

If you choose to use the Service or visit the Site, your use, visit and any dispute over privacy is subject to this Privacy Policy. Logikcull may change this Privacy Policy from time to time. Any changes to this Privacy Policy will be posted on this page so that you are always aware of Logikcull's policies. If Logikcull makes any material changes Logikcull will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this website or within the Logikcull Sites prior to the change becoming effective.
